9030 Facility Construction

Facility construction will be undertaken in accordance with the long-range plan adopted by the board of education and the facility design approved by the board.

Any repairs or renovations of school facilities should be undertaken in such a way as to minimize disruption of instructional time and the educational environment.

A.   QUALITY OF CONSTRUCTION

Buildings should be constructed with durable materials that, when possible, permit space to be adapted to various purposes and to be adjusted to changes in technology or the educational program.

The board will not accept substandard construction. In the event of insufficient funding for a project, the board will defer implementing parts of the long-range plan.

B.   CHANGE ORDERS FOR CONSTRUCTION OR REPAIR WORK CONTRACTS

After a contract for construction or repair work has been awarded in accordance with policy 9120, Bidding for Construction Work, the need may arise to amend the terms, conditions, or specifications of the contract.  A contract may be amended by a change order as provided herein and pursuant to the terms of the contract.  Change orders may not be used to evade bidding requirements.

  1. Submission of Proposed Change Order.  When amendments to a contract are considered necessary, the contractor or the architect shall submit a proposed change order in writing to the Superintendent or designee. Any request for expedited review must also be in writing and accompany the proposed change order.    
  2. Review by Superintendent. The Superintendent or designee is authorized to approve or deny change orders involving sums up to $20,000.00.  The Superintendent or designee may approve the change order only after a determination that funding for the change order is available within the established project budget.
  3. Review by the Board. Change orders which (1) involve amounts over $20,000.00, (2) are in excess of the remaining funds in the project budget, or (3) cause the total cost of a contract that has not previously been approved by the Board to exceed $20,000.00 require Board approval.  The Superintendent or designee shall report to the Board no later than the next regular Board meeting all such proposed change orders, along with the Superintendent’s or designee’s recommendation whether to approve each change order. 
  4. Expedited Review. Requests for expedited review must be in writing and state the date by which approval or denial is sought and the basis for the request for expedited review.  The Superintendent or designee shall endeavor to comply with the request for expedited review to the extent feasible. The Superintendent or designee shall report to the Board Chair within three (3) regular business days any change orders that include a request for expedited review and require Board approval.  The Board Chair will then decide whether a special Board meeting must be called to address the proposed change order before the next regular Board meeting.  The Board Chair may, in his or her discretion, appoint a change order review committee made up of two or three Board members in order to facilitate expedited review.     
  5. Report to the Board. All actions taken on change order requests by the Superintendent or designee, or by the change order review committee, shall be reported to the Board at its next regular meeting.
